Deelnemersvoorwaarden Muscle N Health
Artikel 1 Definities
Deelnemer: Eenieder die een overeenkomst sluit met Muscle N Health
Muscle N Health, statutair gevestigd te Badhoevedorp en kantoorhoudende te (1171DZ) Badhoevedorp aan de Arendstraat 5A.
Deelnemersovereenkomst: De overeenkomst tussen Muscle N Health en een Deelnemer.
Persoonsgegevens: Alle gegevens verstrekt door Deelnemer aan Muscle N Health zoals weergegeven in de Deelnemersovereenkomst.
Artikel 2 Toepasselijkheid
2.1 Deze Deelnemersvoorwaarden zijn van toepassing op alle rechtsverhoudingen tussen Muscle N Health en iedere Deelnemer.
2.2 Alle bedingen in deze Deelnemersvoorwaarden zijn mede opgesteld ten behoeve van alle bestuurders van Muscle N Health en alle personen die voor Muscle N Health werkzaam zijn en/of door Muscle N Health zijn ingeschakeld.
2.3 Afwijkingen van deze Deelnemersvoorwaarden zijn uitsluitend geldig indien deze uitdrukkelijk schriftelijk zijn overeengekomen.
Artikel 3 Deelnemersovereenkomst
3.1 De Deelnemersovereenkomst tussen Deelnemer en Muscle N Health komt tot stand op het moment dat de (a) Deelnemer alle verzochte informatie zoals weergegeven in de Deelnemersovereenkomst heeft ingevuld en voor akkoord heeft ondertekend of (b) de Deelnemer gebruik heeft gemaakt van de trainingsfaciliteiten van Muscle N Health. De Deelnemersovereenkomst wordt aangegaan voor onbepaalde tijd en is tussentijds conform artikel 6 van deze Deelnemersvoorwaarden opzegbaar.
3.2 De door de Deelnemer ingevulde Deelnemersovereenkomst en deze Deelnemersvoorwaarden vormen gezamenlijk de volledige weergave van de rechten en verplichtingen van Muscle N Health en Deelnemer en vervangen alle eerdere schriftelijke en mondelinge aankondigingen, afspraken en alle andere correspondentie.
3.3 Deelnemer zorgt ervoor dat alle gegevens - waarvan Muscle N Health aangeeft dat deze wenselijk zijn of waarvan Deelnemer redelijkerwijs behoort te begrijpen dat deze voor de uitvoering van de Deelnemersovereenkomst noodzakelijk zijn - tijdig aan Muscle N Health worden verstrekt.
3.4 De Deelnemersovereenkomst is persoonsgebonden en Deelnemer is niet gerechtigd de rechten en plichten die voortvloeien uit de onder deze Deelnemersvoorwaarden gesloten Deelnemersovereenkomst geheel of gedeeltelijk aan derden over te dragen.
3.5 Indien een Deelnemer een Deelnemersovereenkomst met Muscle N Health heeft afgesloten, dan is de Deelnemer gerechtigd om gedurende 14 (zegge: veertien) dagen na het ondertekenen van de met Muscle N Health gesloten Deelnemersovereenkomst te herroepen.
3.6 Indien de Deelnemer de Deelnemersovereenkomst conform artikel 3.5 herroept, dan ontvangt Deelnemer alle door Deelnemer aan Muscle N Health gedane betalingen retour, tenzij de Deelnemer reeds gebruik heeft gemaakt van de faciliteiten van Muscle N Health en/of u de locatie van Muscle N Health heeft betreden.
3.7 Indien de Deelnemer besluit een nieuw/aanvullend product bij Muscle N Health af te nemen dan blijven de voorwaarden van de Deelnemersovereenkomst en deze Deelnemersvoorwaarden onverkort van toepassing tenzij uitdrukkelijk schriftelijk anders is overeengekomen.
3.8. Muscle N Health heeft het recht deze Deelnemersvoorwaarden eenzijdig te wijzigen.
3.9 De minimumleeftijd om zelfstandig een abonnement af te sluiten is 18+.
Artikel 4 - Prijzen en betaling
4.1 De abonnementskosten voor het maandelijkse gebruik van de faciliteiten van Muscle N Health dienen voorafgaand aan het gebruik daarvan aan Muscle N Health te zijn voldaan.
4.2 De Deelnemer machtigt Muscle N Health door akkoord te gaan met deze Deelnemersvoorwaarden om de aan Muscle N Health verschuldigde abonnementskosten middels automatische incasso af te schrijven.
4.3 Betalingen die reeds door Deelnemer zijn gedaan worden niet gerestitueerd, tenzij sprake is van een rechtsgeldige herroeping door de Deelnemer in de zin van artikel 3.5.
4.4 Muscle N Health behoudt zich het recht voor haar prijzen en tarieven te indexeren en wijzigen.
4.5 De door de Deelnemer verschuldigde abonnementskosten voor het gebruik van de faciliteiten van Muscle N Health, welke faciliteiten als gevolg van omstandigheden welke buiten de macht van Muscle N Health liggen niet of niet volledig kunnen worden gebruikt, zullen niet worden gerestitueerd.
4.6 Indien Muscle N Health haar faciliteiten niet aan Deelnemer kan aanbieden vanwege een overheidsbeperking worden betalingen die reeds door Deelnemer zijn gedaan niet gerestitueerd. Abonnementskosten zullen pro rata pas weer worden geïnd vanaf de datum dat Muscle N Health haar faciliteiten weer aan Deelnemer kan aanbieden.
4.7 Indien Muscle N Health haar faciliteiten slechts deels aan Deelnemer kan aanbieden vanwege een overheidsbeperking worden betalingen die reeds door Deelnemer zijn gedaan niet gerestitueerd. Muscle N Health heeft het recht om tijdens een periode van sluiting wegens overheidsbeperking een nieuw (vergelijkbaar) buiten- en onlineabonnement aan te bieden aan Deelnemer. Deze abonnementsvorm is geldig zo lang Muscle N Health haar faciliteiten niet of slechts deels binnen kan aanbieden. Indien de overheidsbeperking vervalt, worden zo spoedig mogelijk de faciliteiten van Muscle N Health weer volledig aangeboden, en wordt het oorspronkelijke abonnement weer aangeboden en vervalt de vervangende abonnementsvorm. Gedurende een periode waarin een beperking tot binnensporten opgelegd door de overheid, heeft Muscle N Health het recht om de abonnementskosten van Deelnemers te blijven incasseren volgens het op dat moment afgesloten abonnement door Deelnemer.
Artikel 5 Aanmelding en annulering lessen
5.1 Deelnemer dient zich voorafgaand aan een les aan te melden via het daarvoor bestemde online aanmeldingssysteem. Zonder aanmelding kan niet worden deelgenomen aan een les.
5.2 Deelnemer kan zich tot uiterlijk twaalf (12) uur voor aanvang van een groepsles nog uitschrijven. Zonder en/of bij niet-tijdige uitschrijving gaat één inschrijvingskrediet verloren.
5.3 Muscle N Health wil graag iedereen een plek geven om te trainen. Wordt er te laat geannuleerd, zoals beschreven in artikel 5.2, dan brengt Muscle N Health een bedrag in rekening van vijf euro (€ 5.00) per te laat of niet geannuleerde les.
Artikel 6 Opzegging Deelnemersovereenkomst
6.1 Deelnemer kan de Deelnemersovereenkomst met inachtneming van een opzegtermijn van één (1) kalendermaand schriftelijk opzeggen. Muscle N Health zal na ontvangst van de schriftelijke opzegging van de Deelnemer aan de Deelnemer binnen veertien (14) dagen een bevestiging toesturen. Mocht de Deelnemer deze bevestiging niet tijdig hebben ontvangen, dan dient de Deelnemer onmiddellijk contact op te nemen met Muscle N Health, bij gebreke waarvan Muscle N Health ervan uitgaat dat de schriftelijke opzegging niet of niet tijdig heeft plaatsgevonden.
6.2 Bij langdurige ziekte, blessure en/of zwangerschap van de Deelnemer kan de Deelnemersovereenkomst na overleg en overlegging van een schriftelijke doktersverklaring tijdelijk worden opgeschort dan wel stopgezet.
6.3 Muscle N Health heeft het recht om de Deelnemersovereenkomst met onmiddellijke ingang op te zeggen, indien: De Deelnemer zich naar de mening van Muscle N Health schuldig maakt aan ontoelaatbaar gedrag; Als de Deelnemer de regels van Muscle N Health stelselmatig overtreedt; of Indien een derde als gevolg van enig nalaten of met medeweten van de Deelnemer gebruik maakt van de Deelnemerskaart van de Deelnemer.
Artikel 7 Risico en Aansprakelijkheid
7.1 Het gebruik van de faciliteiten van Muscle N Health voor onder meer niet beperkt tot kracht en conditietraining en/of het volgen van enig trainingsprogramma en/of activiteiten van welke aard dan ook bij Muscle N Health is geheel voor eigen rekening en risico van de Deelnemer.
7.2 Deelnemer is verplicht zowel vooraf, tijdens als na afloop van enige door een trainer begeleidde training melding te maken van zijn of haar fysieke gesteldheid zoals blessures, ziekten en/of andere lichamelijke aandoeningen en/of informatie te verschaffen waarvan deelnemer redelijkerwijs behoort te begrijpen dat deze voor het uitoefenen van oefeningen noodzakelijk is. Deelnemer is zelf verantwoordelijk voor het melden van deze informatie.
7.3 Zowel Muscle N Health als haar medewerkers zijn niet aansprakelijk voor materiële en/of immateriële schade als gevolg van een ongeval of letsel/blessures van de Deelnemer en/of derden.
7.4 Muscle N Health en haar medewerkers aanvaarden geen enkele aansprakelijkheid voor schade, verlies of diefstal van eigendommen van Deelnemer en/of derden.
7.5 Deelnemer is aansprakelijk voor schade toegebracht aan eigendommen van Muscle N Health, indien deze schade gevolg is van nalatigheid en/of schuld van de Deelnemer.
7.6 De uitsluitingen en beperkingen van aansprakelijkheid als in dit artikel vermeld, worden evenzeer bedongen voor en ten behoeve van ondergeschikten van Muscle N Health en ieder ander van wiens hulp Muscle N Health gebruik maakt bij de uitvoering van de Deelnemersovereenkomst.
Artikel 8 Persoonsgegevens en privacy beleid
8.1 Deelnemer is zich bewust dat hij/zij bepaalde persoonsgegevens aan Muscle N Health verstrekt, zoals onder meer naam, leeftijd, adres en emailadres.
8.2 De Deelnemer gaat akkoord met deze voorwaarden, geeft de Deelnemer aan Muscle N Health toestemming tot de verwerking van zijn/ haar persoonsgegevens in verband met (onder meer) het aanmaken van een lidmaatschap, het opstellen, versturen en opstellen van facturen, het verstrekken van informatie, het verbeteren van onze dienstverlening en het beantwoorden van vragen die gesteld zijn via bijvoorbeeld de website.
De eventuele verwerking van de persoonsgegevens door Muscle N Health gebeurt conform de Algemene Verordening Gegevensbescherming en haar privacy policy welke is terug te vinden op www.Muscle N Health.nl
8.3 Deelnemer verleent door akkoord te gaan met deze Deelnemersvoorwaarden aan Muscle N Health ondubbelzinnig toestemming om aan Deelnemer aanbiedingen van Muscle N Health per e-mail en anderszins toe te sturen.
Artikel 10 Toepasselijk recht en bevoegde rechter
10.1 Deze Deelnemersvoorwaarden zijn van kracht met ingang van 1 Oktober 2022.
10.2 In het geval dat enige bepaling in deze Deelnemersvoorwaarden nietig mocht zijn of vernietigd mocht worden, laat dit de geldigheid van de overige bepalingen onverlet. Muscle N Health en Deelnemer zullen alsdan in overleg treden teneinde nieuwe bepalingen ter vervanging van de nietige c.q. vernietigde bepalingen overeen te komen, waarbij zoveel mogelijk het doel en de strekking van de oorspronkelijke bepaling in acht wordt genomen.
10.3 Iedere rechtsverhouding met Muscle N Health wordt beheerst door Nederlands recht. Alle geschillen tussen Deelnemer en Muscle N Health die naar aanleiding van of in verband met de Overeenkomst mochten ontstaan, zullen met uitsluiting van ieder ander worden beslecht door de bevoegde rechter te Amsterdam.

Terms and Conditions for Participants of Muscle N Health
Article 1 Definitions
Participant: Any person that concludes an agreement with Muscle N Health.
Muscle N Health, having its statutory seat in Badhoevedorp and holding its office in (1171 DZ) Badhoevedorp at Arendstraat 5A
Participants Agreement: the agreement between Muscle N Health and a Participant.
Personal data: all data provided by Participant to Muscle N Health such as represented in the Participants Agreement.
Article 2 Applicability
2.1 These Terms and Conditions for Participants are applicable to all legal relations between Muscle N Health and each Participant.
2.2 All stipulations in these Terms and Conditions for Participants have also been composed for the benefit of all directors of Muscle N Health and all persons that work for Muscle N Health and/or have been involved by Muscle N Health.
2.3 Deviations from these Terms and Conditions for Participants are solely valid if these have been agreed explicitly in writing.
Article 3 Participants Agreement
3.1 The Participants Agreement between Participant and Muscle N Health is concluded on the moment that the (a) Participant has filled in all required information such as represented in the Participants Agreement and has signed for approval or (b) the Participant has made use of the training facilities of Muscle N Health. The Participants Agreement will be concluded for an undefined time and can be canceled in-between in accordance with article 6 of these Terms and Conditions for Participants.
3.2 The Participants Agreement completed by the Participant and these Terms and Conditions for Participants form jointly the complete representation of the rights and obligations of Muscle N Health and Participant and replace all earlier written and verbal announcements, agreements and all other correspondence.
3.3 Participant ensures that all data - of which Muscle N Health indicates that these are desirable or of which Participant reasonably should understand that these are necessary for the execution of the Participants Agreement shall be provided timely to Muscle N Health.
3.4 The Participants Agreement is person bound and the Participant is not authorized to assign the rights and duties that derive from the Participants Agreement concluded under these Terms and Conditions for Participants, in whole or in part to third parties.
3.5 If a Participant has concluded a Participants Agreement with Muscle N Health, then the Participant is authorized to recall during 14 (said: fourteen) days after the signing of the Participants Agreement concluded with Muscle N Health.
3.6 If the Participant recalls the Participants Agreement in accordance with article 3.5, then Participant receives all payments made by Participant to Muscle N Health back, unless the Participant has already made use of the facilities of Muscle N Health and/or he has accessed the location.
3.7 If the Participant decides to take-off a new/additional product from Muscle N Health, then the terms and conditions of the Agreement and these Terms and Conditions for Participants remain applicable without reservation, unless explicitly agreed otherwise in writing.
3.8 Muscle N Health has the right to unilaterally change these Terms and Conditions for Participants.
3.9 the minimum age to subscribe at Muscle N Health is 18+
Article 4 - Prices and payment
4.1 The subscription costs for the monthly use of the facilities of Muscle N Health must be paid prior to the use thereof to Muscle N Health.
4.2 The Participant authorizes Muscle N Health by agreeing with these General Terms and Conditions to debit the subscription costs due by means of direct debit to Muscle N Health.
4.3 Payments that have already been made by Participant shall not be refunded, unless there is an instance of a legally valid recall by the Participant in the sense of article 3.5.
4.4 Muscle N Health reserves the right to index and change its prices and rates.
4.5 The subscription costs for the use of the facilities of Muscle N Health due by the Participant, which facilities cannot or not fully be used as a consequence of circumstances which lie outside the control of Muscle N Health, shall not be refunded.
4.6 In case Muscle N Health cannot fully offer her facilities to the Participant due to a government restriction, payments that have already been made by Participant shall not be refunded. Subscription costs will be charged pro rata as of the date Muscle N Health can reoffer her facilities to the Participant.
4.7 In case Muscle N Health cannot fully offer her facilities to the Participant due to a government restriction, payments that have already been made by Participant shall not be refunded. During a governmental restriction Muscle N Health has the right to offer a new (similar) outdoor and online subscription to the Participant. This new subscription is valid during the period the governmental restriction applies. From the moment the governmental restriction no longer applies Muscle N Health will as soon as possible offer her facilities to the Participant. As of that moment the original subscription will be charged, and the new subscription will automatically expire. During a period in which a governmental restriction to indoor sports applies Muscle N Health has the right to continue to charge the subscription costs of the Participant according to the subscription concluded at that time by the Participant.
Article 5 - Registration and cancellation of lessons
5.1 The participant must register prior to a lesson via the appropriate online registration system. It is not possible to participate in a lesson without registration.
5.2 Participant can unsubscribe up to twelve (12) hours before the start of a group lesson. For free training, a participant can deregister up to one (1) hour before the start of the free training. One registration credit will be lost without and / or in case of late cancellation.
5.3 Muscle N Health would like to give everyone a place to train. If you cancel too late, as described in article 5.2, Muscle N Health will charge an amount of five euros (€ 5.00) for each class that is canceled or not canceled.
Article 6 Cancellation Participants Agreement
6.1 Participant can cancel the Participants Agreement in compliance with a notice period of one (1) calendar month in writing. Muscle N Health shall send, after receipt of the written cancellation of the Participant, a confirmation to the Participant within fourteen (14) days. Should the Participant not have received this confirmation, then the Participant must immediately contact Muscle N Health, in the absence of which Muscle N Health assumes, that the cancellation in writing has not or not timely taken place.
6.2 In case of long lasting illness, injury and/or pregnancy of the Participant, the Participants Agreement can, after consultation and presentation of a written doctor's statement, be suspended temporarily or stopped.
6.3 Muscle N Health has the right to cancel the Participants Agreement with immediate effect, if: The Participant in the opinion of Muscle N Health, displays unacceptable behavior; The Participant consistently violates the rules of Muscle N Health; or If a third party as a consequence of any omission or with knowledge of the Participant, makes use of the Participants Card of the Participant.
Article 7 Risk and Liability
7.1 The use of the facilities of Muscle N Health for among others but not limited to power and condition training and/or the following of any training program and/or activities of whichever nature at Muscle N Health is entirely for the own account and risk of the Participant.
7.2 Participant is obliged to both before, during and after expiry of any training coached by a trainer, render report of his or her physical condition, such as injuries, illnesses and/or other bodily affections and/or to provide information of which participant reasonably should understand that this is necessary for the execution of exercises. Participant is self-responsible for the reporting of this information.
7.3 Both Muscle N Health and its employees are not liable for material and/or immaterial damage as a consequence of an accident or injuries/sports injuries of the Participant and/or third parties.
7.4 Muscle N Health and its employees accept no liability whatsoever for damage, loss or theft of properties of Participant and/or third parties.
7.5 Participant is liable for damage caused to properties of Muscle N Health, if this damage is the consequence of omission and/or fault of the Participant.
7.6 The exclusions and limitations of liability as stated in this article, are also stipulated for and for the benefit of subordinates of Muscle N Health and any other person of whose help Muscle N Health makes use in the execution of the Participants Agreement.
Article 8 Personal data and privacy policy
8.1 Participant is aware of the fact that he/she provides certain personal data to Muscle N Health, such as among others name, age, address and email address.
8.2 The Participant agrees to these terms and conditions and grants Muscle N Health permission to process his / her personal data in connection with (among other things) the creation of a membership, the preparation, sending and drafting of invoices, the provision of information, improving our services and answering questions that have been asked via, for example, the website.
8.3 Participant grants by agreeing with these Terms and Conditions for Participants to Muscle N Health an unequivocal permission to send to Participant offers of Muscle N Health per e-mail and otherwise.
Article 10 Applicable law and competent court
10.1 These Terms and Conditions for Participants are in force with effect of 1 Oktober 2022.
10.2 In case that any stipulation in these Terms and Conditions for Participants should be invalid or should be invalidated, then that leaves the validity of the other stipulations unaffected. Muscle N Health and Participant shall then enter into consultation, in order to agree new stipulations for the replacement of the invalid or invalidated stipulations to, whereby as much as possible the purpose and the tenor of the original stipulations will be observed.
10.3 Each legal relation with Muscle N Health will be governed by the Laws of the Netherlands. All disputes between Participant and Muscle N Health that might arise further to or in connection with the Agreement, shall with exclusion of other be resolved by the competent court in Amsterdam, the Netherlands.
